What is Mediation?





Mediation is a process in which individuals meet with a neutral party in an attempt to resolve disputed issues with the objective of reaching a mutually agreeable, workable solution.

Mediation is a confidential process.  The mediator is strictly prohibited from disclosing the contents of mediation sessions except under very limited circumstances.  The mediator does not report to the Court on the conduct of the parties in the mediation.

It is essential that the individuals involved in the mediation session are able to negotiate with authority and make commitments.

The mediator does not advocate for one side or the other, and does not render any decisions. The mediator assists the parties and their attorneys in reaching a settlement of the dispute. The mediation process is non-adversarial, and the parties voluntarily participate.

The process of mediation usually takes several hours, but allows the parties to consider all aspects of their dispute, not just strictly legal issues.

If successful, the parties enter into a written binding Mediation Settlement Agreement which may or may not be filed with a Court.
